Terms of Service

Agreement to terms

By creating an account or using The Shack (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Chalke Customs (ABN 28 640 532 561), based in Australia.

Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these terms on your behalf.

Your account

You are responsible for maintaining the security of your account credentials. You must not share your password or allow others to access your account. Notify us immediately if you suspect unauthorised access.

You may belong to one or more households. Household admins can invite or remove members and manage household settings. Content you create within a household is visible to all members of that household.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Upload content that is defamatory, obscene, or infringes on the rights of others.
  • Attempt to gain unauthorised access to other accounts or our systems.
  • Interfere with the operation of the Service or impose unreasonable load on infrastructure.
  • Use automated tools, bots, or scrapers to access the Service without our prior written consent.

Subscriptions and payment

The Shack offers a free tier and a paid Pro tier. Pro subscriptions are billed monthly or annually. On web and Android, payments are processed by Stripe. On iOS, payments are processed via Apple In-App Purchase.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are handled according to the policies of your payment provider (Stripe or Apple).

Content and data

You retain ownership of all content you create within the Service. By using the Service, you grant us a limited licence to store, process, and display your content solely for the purpose of providing the Service to you and your household members.

We may use anonymised, aggregated data to improve the Service. We will not use your identifiable personal data for marketing to third parties.

AI features

Certain Pro features use AI to generate suggestions, summaries, and insights based on your household data. AI outputs are informational and may not always be accurate. You should not rely on AI outputs as professional advice (financial, legal, or otherwise).

Service availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages beyond our control. We are not liable for any loss resulting from Service unavailability.

Termination

You may delete your account at any time from the account settings page. We may suspend or terminate your account if you violate these terms, with notice where practicable.

Upon deletion, your personal data is removed in accordance with our Privacy Policy.

Your rights under the Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded.

Our services come with guarantees that cannot be excluded. Among other things, you are entitled to have services supplied with due care and skill and within a reasonable time. If we fail to meet a consumer guarantee you may be entitled to a remedy, including a refund for a major failure. To the extent any part of these terms is inconsistent with those rights, that part does not apply to you.

Limitation of liability

This section applies subject to the section above, and only to the extent the law permits.

The Service is provided on an “as is” and “as available” basis. Other than the guarantees that cannot be excluded, we make no warranty that the Service will be uninterrupted, error-free, or fit for any particular purpose.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss, or for loss of profits, revenue, data, or goodwill, arising from your use of the Service. Where our liability cannot be excluded but can be limited, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months preceding the claim, or AU$100.

We are not liable for loss you could have avoided by taking reasonable steps, or for loss caused by your breach of these terms, your misuse of the Service, or the acts of other members of your household.

Your responsibilities

You are responsible for the content you put into the Service and for how you use it, including whether you have the right to upload a document or share another person’s information with your household. You agree to indemnify us against claims, losses and costs arising from your breach of these terms, your content, or your unlawful use of the Service, except to the extent we caused the loss.

Household admins can invite and remove members, change household settings, and see content created in that household. Choose who you share a household with accordingly — we cannot mediate disputes between housemates.

Not professional advice

The Service helps you record and organise household information, including bills, expenses and shared costs. It does not provide financial, legal, tax, medical or other professional advice, and figures it calculates or summarises — including anything generated by AI features — are for your own reference. You should not rely on them as a substitute for advice from a qualified professional, or as a record for taxation or legal purposes.

Third-party services

The Service depends on third parties including Amazon Web Services (hosting), Stripe and Apple (payments), and Anthropic (AI features). We are not responsible for the acts, omissions, availability or terms of those providers. Payments are governed by the terms of the relevant payment provider in addition to these terms.

Your data and backups

We take reasonable steps to keep your data safe, but you should not treat the Service as your only copy of anything important. Export or keep your own copy of documents and records you cannot afford to lose. To the extent permitted by law, we are not liable for loss or corruption of data.

Events outside our control

We are not liable for any failure or delay caused by something beyond our reasonable control, including outages or changes at our hosting, payment or AI providers, network failures, natural events, or government action.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated terms.

Resolving a problem

If something goes wrong, contact us first — most issues are resolved quickly and informally. If we cannot resolve it, you agree to give us written notice describing the problem and what you are asking for, and to allow 30 days to respond, before starting legal proceedings. This does not stop either of us seeking urgent injunctive relief, and it does not limit your right to complain to a consumer protection regulator.

Governing law

These terms are governed by the laws of the State of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales, and you and we submit to the non-exclusive jurisdiction of those courts.

General

If any part of these terms is found to be unenforceable, that part is severed and the rest continues to apply. If we do not enforce a right straight away, that is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours if we sell or restructure the business, provided your rights are not reduced. These terms, together with our Privacy Policy, are the entire agreement between us about the Service. The sections covering your responsibilities, limitation of liability, governing law and this section survive termination.
